Who is LVNV?

LVNV Funding is a collection agency that buys up old debts and the tries to collect on them. It also goes by several other names, including Resurgent Capital Services, LP, LVNV Funding Capital Management Services, Astra, Venta, among others.

In a recent case a consumer alleged LVNV made a series of twenty‐six telephone calls in violation of the FDCPA and TCPA. The lawsuit alleged LVNV, "engaged in conduct the natural consequence of which is to harass, oppress, or abuse by using an automatic telephone dialing system or pre‐recorded or artificial voice in placing telephone calls to Plaintiff's cellular telephone to which Plaintiff had not consented. The Court denied a motion to have the FDCPA claim dismissed. Clarke v. Weltman, Wienberg & Reis, Co.,L.P.A. and LVNV Funding, LLC, 2010 U.S. Dist. LEXIS 71344 (S.D. FL 2010).
